These terms apply to participants in the Design by Artist Affiliate Program (the "Program").
These terms explain how Design by Artist operates its Affiliate Program and the various ways that you are permitted to take part in this Program. Please read these terms carefully before joining the Affiliate Program. By joining or taking part in the Program, you agree with the terms and policies set forth in the agreement (“Agreement”) below.
What is Design by Artist Affiliate Program?
The Affiliate Program allows any individual to earn a referral commission from referring customers to www.designbyartist.com ("our website"). Referral commission will be generated when a new customer, referred by an affiliate, purchases a product in our store. This referral commission becomes valid when the customer must complete the order form and remit full payment for the product.
Registration
To join the Design by Artist affiliate program, contact us via email cs@designbyartist.com for registration. After you register, your application will be sent for approval. If approved, you will have access to your own dashboard, where you can view your referred visits and purchases, generate your tracking links and etc..
By becoming our affiliate, you are entitled to the following:
Tiered commission system based on total sales referred (ranging from 3%-5% of sales).
Payouts when you reach the minimum $100 via PayPal.
Commissions are paid on the 30th of each month.
Exclusive affiliate discounts.
Commissions
Design by Artist uses an affiliate tracking system to tabulate and track sales and commission payments due to our affiliates after the tracking process and purchases are completed. Through the affiliate tracking system website, you will have access to the information that we use to determine the commissions we owe you.
Commissions will only be paid on sales that are made when the customer clicks through qualified, correctly structured Affiliate links. Properly coded links are the sole responsibility of the affiliate. Commissions can be viewed on the Affiliate Dashboard.
Design by Artist reserves the right to increase or decrease commission rates from time to time as it sees fit. There is no maximum commission limit.
Payment
An Affiliate can request a payment when their balance reaches a minimum balance of $100 USD. Payments can be requested every 30 days. Payment processing can take up to 15 days from the requested date and will generally be paid out via PayPal.
Refunds
In the event a customer requests a refund for a transaction for which the Affiliate has earned commissions, any commissions earned on the refund amount will be deducted from the Affiliate’s balance.
Social Media
Design by Artist permits you to promote offers on Facebook, Twitter, blogs, discussion forums, and other social media following these general guidelines:
You ARE ALLOWED to post your affiliate links on your own social media and websites.
You ARE PROHIBITED from posting your affiliate links on social media and the websites of Design by Artist.
Relationship
This Agreement shall not be construed to create any employment relationship, agency relationship, or partnership between you and Design by Artist. You will provide services for Design by Artist as an independent contractor. You will have no authority to bind Design by Artist into any agreement, nor will you be considered an agent of Design by Artist in any respect.
Design by Artist will not be responsible for any taxes that you owe arising out of your relationship with Design by Artist as set forth in this Agreement. Design by Artist will not withhold any taxes from the commissions paid to you.
You shall include a disclosure statement within any and all pages or posts where you use affiliate links in an endorsement or review, and where it is not clear that the link is a paid advertisement. This disclosure statement should be clear and concise, stating that Design by Artist is compensating you for your review or endorsement.
Confidentiality
Any information that you are exposed to by virtue of your relationship with Design by Artist under these terms and policies, which information is not available to the general public, shall be considered to be confidential company information. You may not disclose any confidential company information to any person or entity, except where compelled by law, unless you obtain prior written consent for such disclosure from Design by Artist.
Liability
Design by Artist will not be liable for any loss of profits or costs, or for any direct, indirect, special, incidental, or consequential damages, including costs associated with the procurement of substitute goods or services (whether Design by Artist was or should have been aware or advised of the possibility of such damage), arising out of or associated with any loss, suspension, or interruption of service, termination of this Agreement, or other performance of services under this Agreement.
Termination
This Agreement begins when Design by Artist accepts you into the Program and will end when your participation is terminated.
You or Design by Artist may suspend or terminate your participation in the Program at any time for any reason. You are only eligible to earn commissions while you are participating in the Program in accordance with the terms of this Agreement.
Modification
We may modify any of the terms and conditions within this Agreement at any time and at our sole discretion. These modifications may include, but not limited to changes in the scope of available commissions, commission schedules, payment procedures, and Affiliate Program rules.
